**RENTAL TERMS AND CONDITIONS**
These general terms and conditions are an integral part of the contract you enter into with Domaine KOMBAWA. We encourage you to read them carefully to avoid any misunderstandings or inconveniences during your stay. It is your responsibility to ensure these terms are adhered to by all parties present during the stay.
**BOOKING**
To confirm a reservation, an ID in the name of the person making the booking is required. Online payment for the reservation must also be made with a credit card in the same name. If we are unable to fulfill your reservation request, any deposit paid will be fully refunded. Reservations made by anyone under 18 years of age on the day of booking will not be accepted.
**PAYMENT**
Prices are in Euros, plus 4% Local taxes. A reservation is only confirmed once the deposit (50% of the total rental price) is received. The balance must be paid no later than 30 days before arrival. Failure to pay the balance within this time frame will be considered a cancellation.
For bookings made less than 30 days before the start of the rental period, the total price of the stay must be paid at the time of booking.
The rental price includes all charges (water/electricity, Wi-Fi).
For reservations made by mail, phone, or internet, the tenant does not benefit from a cooling-off period, in accordance with Article L.121-20-4 of the Consumer Code relating to accommodation services provided on a specified date or at a regular interval.
**CANCELLATION BY THE GUEST**
If you wish to cancel your reservation for any reason, you must send us an email. The cancellation becomes effective on the date we receive your email.
Cancellation policy:
– More than 60 days before the stay: 100% refund of the amount paid.
– Between 60 and 30 days before the stay: 50% refund of the amount paid.
– Less than 30 days before the stay: no refund.
– Peak season (Dec 22th to Jan 5th) : No refund.
– No-shows: no refund.
– Early departure for any reason will not entitle you to any reduction in the rental cost.
**CANCELLATION BY THE OWNERS**
In exceptional cases, the owners may need to cancel the contract before the start of the trip if it becomes impossible to fulfill due to unforeseeable, extraordinary circumstances (illness, death, fires, etc.). In such cases, Domaine KOMBAWA will refund all amounts paid in full and will not be liable for further compensation.
**ARRIVAL AND DEPARTURE**
The rental cannot be extended without our prior agreement. Arrival and departure times are specified in the listings. The Client must adhere to these times. Upon departure, all keys must be left in plain sight in the apartment. Replacement costs will be charged to the Client for any lost keys. If your arrival is delayed, please notify Domaine KOMAWA as soon as possible so that arrangements can be made for your welcome.
**ACCOMMODATION**
The properties we offer are intended exclusively for tourist or private vacation use. Any commercial or professional activity, including filming and photo sessions, is strictly prohibited at the rental property (upon request only). Our policy prohibits festivities on the property (e.g., weddings, receptions, etc.) without prior agreement at our discretion and that of the owner. The occupancy of the accommodation is strictly limited to the number of people (including children) specified. Overcrowding is not allowed. In all cases, the maximum occupancy capacity indicated in the description must not be exceeded. If there is a discrepancy in the number of occupants, Domaine KOMBAWA reserves the right to cancel the reservation.
**YOUR RESPONSIBILITIES**
The client acknowledges and accepts the rental premises as is, based on the condition described ont he website. Any items found missing or damaged beyond normal wear and tear will need to be either paid for or replaced by the client, subject to the owner’s approval.
**PETS**
Unless written permission is given, pets are not allowed.
**CLEANING SERVICES**
Complete cleaning of the property is carried out before each rental period. Even if the final cleaning service is included, you are required to leave the property in a reasonably clean state upon departure. If the cleanliness of the property on the day of your departure requires additional cleaning beyond what is planned, the owner is authorized to take necessary measures and charge the corresponding costs to the security deposit.
**INSURANCE**
Domaine KOMBAWA is not liable for theft or burglary in the rented premises. The owner declares that the building or part of the building belonging to them is insured for risks concerning them, but the client must insure for risks related to their rental responsibility or covering their personal belongings. Generally, your home insurance contains a “holiday” or similar clause, which should cover your liability in case of problems during your rental. It is your responsibility to check this. By accepting the rental conditions on the booking form, you expressly certify that your situation complies with our rentals terms and conditions.
**ACCESS TO THE RENTAL**
Domaine KOMBAWA is authorized, in case of force majeure or for maintenance purposes, to freely access the vacation rental. Should this occur, you would be systematically notified in advance.
**OWNER’S RESPONSIBILITIES**
Domaine KOMBAWA undertakes to provide the client with the rented accommodation as described in the listing and to fulfill the obligations resulting from this contract. Domaine KOMBAWA cannot at any time be held responsible for death or bodily injury concerning persons present in the rental during your stay.
Domaine KOMBAWA cannot at any time be held responsible for losses, breakages, or delays whose causes are beyond their control, including, but not limited to: natural disasters, explosions, floods, storms, fires, or other measures emanating from local or government authorities, strikes, etc. In any of the aforementioned cases, we will have the right to consider the contract null and void, and our responsibility will be limited to the refund of the amounts you have paid us, calculated pro rata for unoccupied periods. Interruptions in General Services (water, electricity, etc.) and likewise for public services (water pipes, electricity, telephone, internet access, etc.) do not justify a rent reduction if they are not due to an act of will of the lessor. Domaine KOMBAWA declines all responsibility for any deprivation or reduction in enjoyment. The owner and/or their agent cannot at any time be held responsible for noise nuisances or disturbances coming from outside the holiday rental, or whose causes are beyond our control.
**SAFETY AND VALUABLES**
Domaine KOMBAWA is situated in an ultra-secure residential area, offering a peaceful and safe environment for all its residents. Despite our stringent security measures and vigilant approach to maintaining a secure atmosphere, it’s important to note that unforeseen incidents, although highly unlikely, could still occur. With this in mind, Domaine KOMBAWA cannot at any time be held responsible for theft, property damage, any criminal act, or any assault of which the tenant may be the author or victim in the rented property. It is your responsibility to take necessary and appropriate measures to protect yourself against any unpleasant surprises and to safeguard your valuables. Guests are advised to take the necessary precautions to prevent accidents to themselves or their family (especially children). The owner declines all responsibility in this matter.
Please note that our pool area does not have a security system in place, and the same applies to the stairs around our property. Additionally, there are certain areas within our domain that are not fully secured. We kindly remind parents and guardians that the safety of children is entirely their responsibility. We urge you to keep a watchful eye on your little ones and ensure they are safe at all times during your stay.
**APPLICABLE LAWS**
These rental conditions and the rental contracts made are subject to French law. In case of a dispute, an amicable solution will be sought first. If the dispute persists, exclusive jurisdiction will be attributed to the competent court.
**PROTECTION OF THE PARTIES’ PERSONAL DATA**
Your personal data collected in the context of this contract are subject to processing necessary for its execution. They may be used in the context of the application of regulations such as those relating to the fight against money laundering and the financing of terrorism. In accordance with the Data Protection Act, you have the right to access, rectify, delete, oppose, and port your data by contacting kombawasxm@gmail.com.
